A restaurant owner in South London has lost a bizarre case at the employment tribunal after a former employee accused him of unfair dismissal, following allegations he was farted on, burped at and shown photos of poo amongst other unprofessional behaviour. Edgar Simplico, who worked as a waiter at L’antipasto, in Battersea, made the allegations against his former boss Alessandro Cretella, who he claims subjected him to this behaviour for more than 12 months. As part of official documentation in the case, Mr Simplico formally alleged that his former boss would regularly burp in his face, on one occasion asked him if he wanted to see a picture of his poo and would regularly fart and waft it in his direction. Mr Cretella denied all allegations at the tribunal, claiming he suffered from oephophagitis and thus cannot control when he breaks wind or burps but admitted he had a ‘childish’ sense of humour. Following a confrontation in August 2020 in front of a packed restaurant, where Mr Simplico accused the defendant of underpaying him for more than a year, the waiter resigned. As reported by Metro, the employment panel found that Edgar had quit as a result of constructive dismissal and a compensation hearing will be held at a later date. The tribunal concluded ‘that burping near [Mr Simplicio], loudly breaking wind and wafting the smell and asking [Mr Simplicio] if he wanted to see a photo of his faecal matters were inappropriate and amounted to unreasonable conduct.’‘[Edgar] cannot be expected to put up with the behaviour Mr Cretella displayed on that day”.
