It’s one of the most iconic album artworks in the history of music but now the baby that was famously photographed underwater for Nirvana’s ‘Nevermind’ album cover has launched legal proceedings against the band under allegations of child sexual exploitation. Spencer Elden, 30, who was four-months-old when the iconic picture of him was taken, is suing Dave Grohl, Krist Novoselic and the estate of Kurt Cobain for damages of US$150,000 (£122K) per defendant. As reported by TMZ, court documents filed on Tuesday claim ‘the defendants have “violated” federal child pornography statutes and that Elden sustained “injuries” and “lifelong damages” as a result of the defendants’ “commercial child sexual exploitation of him from while he was a minor to the present day.' Nirvana and Kurt Cobain's estate are being sued by the baby from their famous "Nevermind" album cover. https://t.co/9M4sQGWHP3 The 30-year-old says not only could he not consent to the image being used of him as he was only four-months-old, he also alleges the band made a promise to his legal guardians that they would cover up his genitals in the final version of the cover - something that didn’t happen. In comments made in 2016 to TIME, Elden expressed the mental effect it has had on his entire life, saying “When I go to a baseball game and think about it: ‘Man, everybody at this baseball game has probably seen my little baby penis,’ I feel like I got part of my human rights revoked.” Bizarrely, the 30-year-old has recreated the famous image multiple times over the years, with one most recently done in 2016.
