An electrician who claimed he suffered headaches and needed oxygen after being hit on the head by a child’s empty suitcase on an Emirates flight in 2019 has successfully sued the airline and been awarded a payout of AU$5000 (£2,700) - but he was originally offered an out-of-court settlement of AU$15,000 (£8,105). Australian sparky Stephen Bradshaw decided to turn down the originally (and much larger) offer from the airline, opting instead to head to court in the hope of receiving a bigger payout. The incident occurred on a flight from Dublin to Dubai in January 2019, when a fellow passenger opened the overhead storage compartment during the journey which caused a suitcase to fall and hit the tradesman on the head. Electrician wins lawsuit against Emirates after being hit in the head with a falling suitcase mid-flight - but MISSES OUT on $15,000 payout from the airline. https://t.co/tzg5gGs6iu Despite the court hearing witness testimony from the suitcase owner who asked Mr Bradshaw immediately after the incident if ‘he was okay?’, to which he replied ‘yes I am fine, don’t worry’, the electrician claimed he suffered extreme headaches on his following connecting flight and missed out on a days work as a result. As reported by The Daily Mail, While the Federal Court found some of Mr Bradshaw's evidence was embellished and he suffered no economic loss, it made an award of $5000 to compensate for pain and suffering in the days after the incident. 12 months after the incident Emirates offered him $AU15,000 which he declined. The judge said it wasn't established whether the missed work day was due to the suitcase injury or the flu-like illness Mr Bradshaw was also suffering at the time. (H/T Daily Mail)
